California Expungement and Record Clearing
California Expungement, record sealing, and other post-conviction relief proceedings can be very complicated depending on the facts of the original case and if the District Attorney objects to the court granting the relief. It often takes the ability to argue the facts and the law in front of a judge.
Plus, making it even more confusing is the fact that the application process varies from court to court. Hiring the expungement attorneys at h4ckerspro.com ensures that you do not suffer unnecessary delays because of simple mistakes.
A large percentage of expungement requests that are denied are denied in California because of mistakes made by people who do not have experience with expungement law or dealing with the specific court that is handling their case.
How to Expunge Your California Record
Expungement, which is often called a 1203.4 Dismissal, is a form of post conviction relief that is initiated by the filing of a motion with the court that convicted the person. The motion asks the judge to reopen the case, review the facts and the content of the motion — as well as any evidence that is submitted, and then to take away the finding of guilt and dismiss the court case.
Our law firm can handle all of the details, including doing the research, formulating a strategy for success and making sure everything goes well at court. We have done it for more than 5,000 Californians.
What Record Clearing Options Are Available in CA?
The simplest and fastest way to see which of the CA services are available for your case is to take our confidential online eligibility test. Below is a brief summary for some of the California services we offer. For more information, please visit the service page for the service you are eligible for in CA.
If you received probation as your sentence, you are most likely eligible for an expungement in California. This is true if your offense was an infraction, a misdemeanor, or even a felony. You may also be eligible to expunge California DUI convictions.
While it makes the expungement process a bit more challenging, you can even expunge your case if you violated your probation. To learn more about expungements pursuant to Penal Code 1203.4. in California please view our page on CA expungements.
As mentioned above, if you have a case that resulted in a felony conviction, for which you were sentenced to probation, the best option is usually an expungement.
However, if the felony resulted in time served in state prison, expungement is not an option, but you could be eligible for a Certificate of Rehabilitation. Learn more about what your options are on our California felony expungement page or by taking the eligibility test.
If you have a felony on your record, you could be able to get that case reduced to a misdemeanor on your record. Many felony cases that ended in probation can be reduced to misdemeanors pursuant to Penal Code section 17(B).
Reducing a felony to a misdemeanor restores firearm rights that were lost because of that conviction. This service is beneficial even if you are getting the case expunged, and we offer the reduction as part of a felony expungement at no additional cost if you are eligible.
Certificate of Rehabilitation
If the case was a felony that resulted in time being served in state prison, a Certificate of Rehabilitation, pursuant to Penal Code 4851, will likely be an option. Obtaining a Certificate of Rehabilitation will create an automatic application for a pardon from the governor, put a positive mark on your record and open you up to potential professional and vocational licenses that were previously unavailable.
If a person is still on probation, it is possible to return to court and ask the judge to end the probation sentence. We generally advise clients wait until they have completed half of their probation term before petitioning the court for this relief. Once the probation is terminated, the person can usually request that the record be expunged. Please see our probation termination service for more information.
Arrest Record Sealing
If you were arrested in California and the arrest did not result in a conviction or some form of diversion program, then your arrest is probably eligible for an arrest record sealing pursuant to Penal Code section 851.8.
To get an arrest record sealed, the judge must find that “no reasonable cause exists to believe that the arrestee committed the offense for which the arrest was made.” This is a high standard to meet, but for a small fee we would be glad to review all of your case records and let you know your chances of success.
Other Record Sealing Services
- Drug diversion sealing is available if your record involved a drug diversion program that was successfully completed.
- Juvenile record sealing may be an option if the record was from when you were under eighteen years old.
- Juvenile set aside is available for many of those who were sentenced to and honorably discharged from the California Youth Authority (CYA).
